1. Introduction
Welcome to SoftMirrorLounge ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our luxury yacht rental services and our online platform located at softmirrorlounge.site (the "Service"), managed by SoftMirrorLounge.
By making a reservation or employing our Service, you consent to comply with these Terms. Should you object to any portion of these terms, you are advised not to utilize the Service.
2. Service Overview
SoftMirrorLounge offers high-end yacht rental services, which include but are not limited to:
- Day-long yacht hire
- Evening yacht tours
- Company retreats
- Exclusive gatherings
- Extended yacht charters
Our services are contingent upon availability and conducive weather conditions. We maintain the discretion to alter or terminate services at our discretion.
3. Booking and Reservations
3.1 Booking Process
For a reservation, the following requirements should be met:
- Attain the age of 18 years or older
- Supply valid and complete information
- Remit the specified deposit as noted in your reservation confirmation
- Accept these Terms & Conditions
3.2 Confirmation
Confirmation of your booking is subject to the receipt of your payment and our formal confirmation. Service provision is subject to our discretion.
3.3 Availability
Charters are offered based on the availability of vessels and favorable meteorological conditions. We will make sincere efforts to accommodate your requested dates and times.
4. Payment Terms
4.1 Pricing
All charges are provided in € and incorporate all applicable taxes unless indicated otherwise. Prices are susceptible to alterations without prior notice.
4.2 Payment Schedule
- Deposit: 50% of the full cost of the yacht charter, payable at the time of booking
- Remaining balance: Payable 48 hours prior to the departure of the charter
- Incidental expenses (if applicable): Payable subsequent to the completion of the charter
4.3 Payment Methods
We accept a variety of major credit cards, direct bank transactions, and certified bank drafts. Payment processing undergoes secure, encrypted means.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- In excess of 72 hours before departure: Full reimbursement minus processing expenses
- Between 24 to 72 hours before departure: Refund of 50%
- Less than 24 hours prior to departure: Ineligible for a refund
5.2 Weather Cancellations
In the situation where the captain declares weather conditions as unsafe, we propose either to:
- Rebook your charter for a forthcoming available slot at no extra fee
- Issue a complete refund if rescheduling proves unfeasible
5.3 Mechanical Issues
If mechanical impediments occur with the designated vessel, efforts will be made to provide a comparable alternative. If such is unavailable, we shall issue a complete reimbursement.
6. Safety and Conduct
6.1 Safety Requirements
All guests must:
- Adhere to instructions given by the crew
- Don safety gear as instructed
- Inform of any health conditions that may impact their safety
- Stay within outlined areas on the vessel
6.2 Prohibited Items
Certain items are prohibited aboard, such as:
- Glass containers
- Illicit materials
- Firearms or other armaments
- Excessive amounts of non-alcoholic beverages beyond reasonable personal consumption
- Pets (except under prior approval)
6.3 Behavior
Guests are expected to behave in a manner that is respectful to all on board. Should their conduct pose a risk to safety or hamper the enjoyment of others, we withhold the right to terminate their charter prematurely and without rebate.
7. Liability and Insurance
7.1 Our Liability
Liability on our part is confined to the quantum paid for the charter. We shall not be liable for:
- Personal injuries caused by the passenger's own negligence
- Loss or damage to personal belongings
- Indirect, incidental, or punitive damages
- Delays stemming from weather or events outside our control
7.2 Insurance
Our operations and vessels are ensured through comprehensive marine insurance. Travel and personal insurance is the responsibility of the passengers.
7.3 Risk Acknowledgment
By engaging with our charter services, you recognize the inherent hazards associated with marine activities, assuming full accountability for personal health and safety.
8. Amendments and Itinerary Adjustments
We hold the right to amend travel plans, pathways, or timetables in response to weather, safety requisites, or operational exigencies. We will endeavor to provide comparable alternatives where feasible.
9. Force Majeure
We bear no liability for alterations, cancellations, or deferments precipitated by factors beyond our governance, including but not limited to:
- Severe meteorological events
- Natural catastrophes
- Regulatory impositions
- Port shutdowns
- Technical failures
10. Privacy and Data Management
Your personal details are managed according to our Privacy Policy. Use of our services implies approval of the collection and utilization of your data as outlined in the Privacy Policy.
11. Copyrights and Trademarks
The contents on our website, which includes textual matter, visuals, symbols, and photographs, are secured by copyright and trademark legislation. The reproduction, distribution, or derivation of works is prohibited sans our explicit authorization.
12. Governing Legislation
These Terms are regulated by the laws in effect within France. Disputes will be settled within the courts situated in Nice, France.
13. Terms Adjustments
We reserve the privilege to modify these Terms as necessary. Amendments will be communicated via our website denoting the updated revision date. Continued employment of our service stands as acceptance of new terms.
